Terms of Service

1. Acceptance of these Terms

By creating a MegaHostZone account, signing in to any Service, or otherwise accessing the Services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Services.

We may publish additional terms specific to a particular product. Where they apply, those product-specific terms supplement these Terms; in case of conflict on a topic addressed by both, the product-specific terms control for that product.

2. Eligibility

You must be at least 13 years old, or older where your local law sets a higher age for online consent or for entering into a binding contract. By using the Services, you confirm you meet this requirement and have the legal capacity to enter into these Terms.

If you are using the Services on behalf of an organisation, you confirm you are authorised to bind that organisation, and "you" refers to both you personally and the organisation.

3. Your account

3.1 One person per account

Each MegaHostZone account is for one natural person. Sharing credentials, transferring an account, or operating multiple accounts to circumvent limits is not permitted.

3.2 Account security

You are responsible for safeguarding your password, any second-factor codes, your recovery email, your recovery phone number, and any other authentication methods registered to your account. Notify us promptly if you suspect unauthorised access. We strongly recommend enabling at least one additional authentication method beyond your password. We are not liable for losses arising from your failure to maintain reasonable account security.

3.3 Accurate information

You agree to provide accurate, current, and complete information at sign-up and to keep it up to date. Submitting deliberately false information is grounds for termination.

3.4 Automated access

You may not use scripts, scrapers, or any automated tooling to access the Services except through our published interfaces and within the limits we publish or enforce. Probing, fuzzing, or attempting to bypass rate limits or security controls is a violation of these Terms regardless of intent.

4. Acceptable use

You may not use the Services to:

• break the law of any jurisdiction that applies to you or to us;
• send spam, phishing messages, or unsolicited bulk communications;
• impersonate another person, organisation, or MegaHostZone itself;
• upload or distribute malware, viruses, or any code intended to disrupt the Services or other users;
• infringe intellectual property, privacy, publicity, or other rights of any party;
• harass, threaten, or harm other users;
• circumvent age-gates, security controls, or rate limits;
• reverse-engineer or decompile the Services beyond what applicable law expressly permits;
• resell, sublicense, or commercially redistribute the Services without a written agreement; or
• interfere with the Services through denial-of-service or any technique that materially degrades performance for others.

We may suspend or terminate any account, refuse a sign-up, or remove content we reasonably believe violates these rules.

5. Suspension and termination

5.1 By you

You may close your account at any time from your account settings. Closure is initially reversible: your account is locked for a short grace period during which it can be restored on request. After that period, your data is permanently deleted, except where we are required by law to retain limited records.

5.2 By us

We may suspend or terminate your account, immediately and without notice, if:

• you breach these Terms or any product-specific terms;
• we reasonably believe your account has been compromised or is being used for fraud;
• we are required to do so by law or court order;
• your account is dormant for an extended period; or
• continuing to provide the Services to you would expose us or other users to legal, security, or reputational risk.

We will give reasonable advance notice where practicable. On termination, your right to use the Services ends immediately; sections of these Terms that by their nature should survive termination — including those covering intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

6. Intellectual property

6.1 Our rights

The Services, including all software, design, page layouts, branding, logos, and trade dress, are owned by MegaHostZone or our licensors and are protected by copyright, trade-mark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Services for their intended purpose. No other rights are granted.

6.2 Your content

You retain ownership of any content you upload to your profile (such as an avatar image or bio). By uploading, you grant us a worldwide, royalty-free, non-exclusive licence to host, store, display, and process that content as needed to provide the Services and to perform routine operations like backups, replication, and content delivery. The licence ends when you delete the content, except for backup copies that may persist for our routine retention period.

You confirm that you own or have the necessary rights to the content you upload, and that it does not infringe anyone else's rights.

6.3 Feedback

If you submit feedback, suggestions, or feature requests, you grant us a perpetual, irrevocable, royalty-free right to use them without obligation, attribution, or compensation. We will not be under any obligation to keep feedback confidential.

7. Third-party services

The Services rely on third-party providers (for example, for cloud hosting, email delivery, SMS delivery, and payment processing if you upgrade to a paid plan). Your interactions with these providers are governed by their own terms; we are not responsible for their actions or omissions, beyond the contractual protections we put in place. The Services may also display links to third-party sites; we are not responsible for the content or practices of those sites.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY — INCLUDING (BUT NOT LIMITED TO) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE FROM ALL FORMS OF ATTACK.

No advice or information you obtain from us creates any warranty not expressly stated in these Terms. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, our warranties are limited to the minimum required by law.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, FROM ALL CAUSES OF ACTION AND ALL THEORIES OF LIABILITY, SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (b) INR 10,000; AND
• WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST OR CORRUPTED DATA, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE PRODUCTS — EVEN IF ADVISED OF THE POSSIBILITY.

THESE LIMITS APPLY EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THEY DO NOT APPLY WHERE PROHIBITED BY LAW (FOR EXAMPLE, LIABILITY FOR GROSS NEGLIGENCE, FRAUD, WILFUL MISCONDUCT, OR STATUTORY LIABILITY THAT CANNOT BE LAWFULLY LIMITED).

10. Indemnification

You agree to defend, indemnify, and hold harmless MegaHostZone, our officers, employees, and agents from and against any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of or related to:

• your use or misuse of the Services;
• your breach of these Terms;
• your violation of any law or third-party rights; or
• any content you upload, transmit, or share through the Services.

We will give you prompt notice of any claim and reasonable cooperation in defending it. You may not settle any claim that imposes any obligation or admission on us without our prior written consent.

11. Disputes and governing law

11.1 Governing law

These Terms are governed by the laws of India, without regard to its conflict-of-law principles, and supplemented by mandatory consumer-protection laws in your jurisdiction where they apply.

11.2 Pre-suit notice

Before filing any formal claim, you agree to send us a written notice describing the dispute using the contact details in §14 and to give us 30 days from receipt to attempt to resolve it amicably.

11.3 Jurisdiction

Subject to the pre-suit notice in 11.2 and to any mandatory consumer-protection forum your local law may grant, the courts at Kolkata, West Bengal, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.

12. Changes to these Terms

We may update these Terms from time to time. The "Version" and "Effective" date at the top of this page indicate the current version. For material changes affecting your rights or obligations, we will notify you in advance and require you to re-accept the updated Terms before continuing to use the Services. Your acceptance record is available from your account settings. Continued use of the Services after the effective date of an update constitutes acceptance of the updated Terms.

13. Miscellaneous

13.1 Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be reformed only to the extent necessary to make it enforceable; the remaining provisions remain in full force.

13.2 No waiver

Our failure to enforce a provision is not a waiver of our right to enforce it later or to enforce any other provision.

13.3 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms, in whole or in part, in connection with a merger, acquisition, or sale of assets, with notice to you.

13.4 Entire agreement

These Terms, together with the Privacy Policy and any product-specific terms incorporated by reference, constitute the entire agreement between you and MegaHostZone regarding the Services and supersede any prior agreements on the same subject.

13.5 Headings

Headings are for convenience only and do not affect interpretation.
